Placing A Value On Your Personal Injury Claim

Your Medical Doctor or Chiropractor has released you from treatment for your motor vehicle accident and enough time has passed so you're about to position yourself to sit down with Adjuster Henry Hard-Nose. His employer is Rock Solid Insurance, the company who insures Fred Fuddle, the individual who plowed into your rear end, smashing you with a tremendous crash which was responsible for your injuries plus the "Pain and Suffering" you've had to endure.

To be adequately compensated for what you've gone through you must have accumulated what's identified in the world of insurance claims as "Special Damages". Those are your Medical bills, your Lost Wages plus every dollar paid out to help with your recovery. When building the value of a personal injury claim there are several key elements you should be aware of:

LIABILITY: In the vast majority of motor vehicle accidents it's clear who was at fault. Assuming that Fuddle struck you a mighty blow in the rear end (rear-enders make up well over half of the motor vehicle accidents that take place in the United States each year) yours is a case that must be settled. (Final Statistics prove that in 83% of accident's that took place in 2003 it's clear who was at fault) !

The very doubtful liability case has little, if any, settlement value. If that's the situation you should obtain the services of the local Legal Beagle who does a good job at that, Attorney I.M. Greedy. But, if you do, be very careful when you sign Greedy's "Contingency Fee Agreement". Read it closely. Don't sign anything that will let him charge you one penny, other than his normal fee. Do not - - in any way whatsoever - - allow him to chisel any money from you, for his out-of-pocket expenses. All Greedy should be compensated for (if he's successful at busting loose some bucks from Rock Solid) is his fee and that should be no more than the usual locally published accepted percentage of the total recovery.

TYPE OF INJURY: If there are severe injuries (which make up only ten to fifteen percent of all motor vehicle accidents) you should obtain the services of a lawyer. But, if you've had minor injuries like whiplash, bumps, bruises, sprains and/or strains (and it's clear you're not at fault) you can handle and settle the claim yourself.

TYPE OF PERSON YOU ARE: Rate yourself and be brutally honest. You're most likely an average motor vehicle owner/driver, living a normal life. But, if you've spent some time behind bars, have a criminal record, or a history of character defects that often get your butt in a jam with the local cops (and this is well-known) you must take those facts into consideration when forming expectations regarding what your case is worth.

THE TYPE OF PERSON FRED FUDDLE IS: The better Fred Fuddle looks, or the better the "entity" "(Fuddle's business or company, etc.) appears, the better for Rock Solid. But, if Fuddle is a known bookie or drug dealer, they're in deep "stuff". On the other hand, if Fuddle is a well-loved philanthropist, that can be a plus for Rock Solid Insurance. Or if the vehicle that struck you was a van driven by Pastor Frederick Fuddle, and the named insured is The Fuddle Camp For Lost Souls, that can be a plus for Rock Solid.

But, if the "entity" that hit you was a dilapidated junk pile on wheels operated by Fred "Goof-Ball" Fuddle, and the named insured is The Fuddle Rotted Cow Manure Corporation, that will obviously not be favorable for Rock Solid.

DAMAGES: There are "Medical Special Damage" Expenses, "Non-Medical Special Damages" Expenses, and/or your "Property Damage" Expenses.

MEDICAL SPECIAL DAMAGE EXPENSES: These typically include Cost of Ambulance, Emergency Room, Hospital and/or Clinic Charges, Chiropractor, and/or Dentist, Over-The-Counter Drugs and/or Prescription Medications, Laboratory Fees and Services, Diagnostic Tests: X-Rays and (CT) Scan, Prosthetic Appliances or Surgical Apparatus, (Cranes & Crutches), Physical Therapy, Registered and/or Practical Nurse Fees, Ace Bandages, Gauze and Tape, Heating Pads, Creams, Lotions, Ointments, Balms and Salves.

When it comes to listing your Medical Special Damage "expenses" don't overlook one single dollar because, when it comes time to settle your claim, that dollar can increase the value of your payment for "Pain and Suffering" by a multiplier of four or even five! (Yes, that means a $20.00 bill can be worth $80.00 to $100.00 more ,in your pocket, from Rock Solid Insurance, at settlement time).

NON-MEDICAL SPECIAL DAMAGES: These typically include Lost Wages and Earnings, Lost Vacation time and/or Sick Leave, Travel Expenses (car rentals, public transportation, expenses incurred getting to and from your Chiropractor and/or hospital and/or physical therapy "treatment" of some sort) Household Help during disability and/or Child Care. Be sure to obtain written proof of such "Non Medical" Special Damages.

LOST WAGES: The income you lost, because you were unable to work, is an area where adjusters take terrible advantage of the typical claimant because they know so little about it.

Commissions and overtime can make a huge difference in your lost earnings. Be sure to get a letter from your employer, on their official letterhead, explaining that in detail. Or, if you're self-employed, get this information stated on your accountants letterhead.

The time you miss from work (thus the money you may have lost) is calculated and this element constitutes what is known as "Lost Wages" or "Lost Time Verification". In most situations you're entitled to compensation for lost time and earnings, even if you have no actual loss of money! Such as, for example, when your salary is paid by your company insurance coverage, or by taking sick leave, or some similar arrangement.

Even if you're salaried you should obtain a "Lost Earnings", or "Time Lost Verification", in writing on your employer's letterhead.

IF YOU'RE SELF-EMPLOYED: To prove your lost earnings you'll probably have to assemble some inside information for Hard-Nose. If you don't like the idea of submitting private documents to him, in the privacy of your home or office, just think how you'd feel about producing them in the non-private environment of a courtroom. When a case goes to trial, and if you want to prove your damages so as to collect adequate compensation, that's your only alternative.

TWO CRITICAL AREAS REGARDING LOST WAGES: Did the injury necessitate a change of job or employment at a lesser rate? Or, did the injury allow your going to work but only on a part-time basis? If the answer to either question is "Yes", it would be wise to ask your employer to document these facts on their letterhead.

IT'S CRUCIAL FOR YOU TO KNOW: Even if you've been paid while out of work, you can still compute your time lost from work as "Lost Wages" .

PROPERTY DAMAGE EXPENSES: These typically include Motor Vehicle Repair, Damaged Clothing, Broken Glasses, cost of Substitute Car Rentals, Towing and Storage. Make copies of all bills relating to any of your property damage expenses. Keep the originals. Be sure to have these in your possession when you and Hard-Nose plunk yourselves down to "Talk Turkey". Photocopies are sufficient to give him.

YOUR AGE: Because of their obvious innocence, insurance claim accident victims, up to the age of 12, generally have excellent settlement results. Those in their teens, and into their late 50's, fall into a fairly normal category because they're generally considered to be at the height of their physical stamina. Those in their late 60's, and over, usually fare extremely well; primarily due to the sympathy that's often invoked, from a judge or jury, because of general attitudes regarding frailty and the elderly.

MOST IMPORTANT TO REMEMBER:The information Hard-Nose places into your file plays a major role in the ultimate value of your claim. Never underestimate the importance of his impressions and conclusions! Should, one day, your case ends up in front of a judge, or jury, what Hard-Nose feels, observes and then reports into your file at Rock Solid about you, his insured Fred Fuddle, and/or possible witnesses, etc., (in addition to the information you've documented for him) could have massive influence on the value of your claim - - especially if Fuddle is a loser and he's absolutely in the wrong. At that point the only thing stalling a settlement is the amount of money it's going cost to get rid of you.

And, should your file end up in the hands of the local defense attorney for Rock Solid Insurance, all the positive factors about you, your injury and liability, will cause him to gasp, "Hey, what's going on here? My legal fees will be higher than the few hundred more bucks this one can be dumped for."

The bottom line: Your out-of-pocket expenses correctly recorded and presented, your injury information properly documented and your lost wages clearly established will seriously increase the dollar value of your personal injury claim.

The Slipping Bra Strap Curse and Alternative Solutions When Conventional Wisdom Fails

If you are reading this article you must have experienced this scenario at some point in time: You are standing there talking to your boss, a customer, or perhaps it is a crowded room full of people and you feel the slow creep of your bra strap as it starts slipping down off your shoulder...what do you do? Do you "adjust" yourself in public by reaching into your shirt and putting that wayward strap back up onto your shoulder? Or do you suffer through the minutes waiting till you have a private moment to step out of the way and put it back?

There are many solutions to solving FBSS (Falling Bra Strap Syndrome). I would first recommend you follow the advice of bra fitting experts and make sure you have the correct size bra, since once you have exhausted the wide range of expert advice your alternatives become limited. Some women convert all of their bras to racer back styles, tighten their straps up so much that they create a dent in their shoulder, wear only sports bras, or stop wearing bras altogether. For some women the problem is solved by a custom fit bra. However, none of these solutions worked for me, so I would use hair barrettes, rubber bands or safety pins to join my straps together to prevent another outbreak of FBSS.

Given the fact that I have found over 15 different items out there that offer solutions for either hiding bra straps or stopping bra straps from sliding, I would say that we are not alone in failing to find a solution through conventional expert advice. So, with all the choices available today, how do you decide which one to choose? It may not be as simple as it seems. Here are seven questions to ask yourself to find a product that will work for you.

1. How often do you need it? You may be one of the lucky women who only suffers from FBSS with on rare occasions. With all the different styles of bras on the market, some fit better than others and they never slip, but as we wash them (and for some dry them, even though we are not supposed to) the straps start to stretch. You could use these products to extend the life of those bras that you love and wear over and over again. Or there may be that one sleeveless top you like to wear, but don't really want to show your bra straps to the world!

2. How flexible are you? Many of the products on the market today require you be able to reach the middle of your back to get the product ON and IN place, something most women can't do on their own. However, some of the products can easily slide into place before you put your bra on, or easily slide into place. In other cases be sure you've got someone there to help you.

3. How tight do you want to pull your straps together? Some of these products pull your straps so that they meet in the middle of the back, others allow more room between the straps. What will be most comfortable for you? If you don't like racer back bras or sports bras, you may want one of the products that leave more room between the straps.

4. Plastic or Fabric? The Fabric style of bra strap holders are usually just like your regular bra strap and will leave more room in between the straps. There are also some plastic versions of this same style. Other plastic versions come in a two varieties: a hard plastic piece in a variety of colors that is roundish in shape and pulls the straps all the way together; or a very flexible plastic that is breathable and moves with you.

5. To see or not to see? Most of these products are not designed to be seen and are only meant to go on your bra straps to hide underneath your clothing. However some of the products may work for your tank tops and swimsuits as well and allow you the opportunity to dress up tank tops with some jewelry on your back.

6. How much to spend? The cost on these vary tremendously; some you can buy just one and some you have to buy in packages of 3 or even 6! They range from $3.50 to $15.

7. Are they guaranteed to work? If there was one single solution to any problem guarantees would not be necessary, so look to see if the product is guaranteed for customer satisfaction.

Keys to the Kieffer Pear

The old, reliable Keiffer pear is unfortunately not the most palatable. But it becomes much more desirable when we know how to ripen and use the fruit.

If you have made up your mind that you must have a pear tree in your back yard, it is well to find out about the characteristics and uses of the various varieties before you purchase your tree. There are pears that are fine for canning but poor for eating raw. Others are excellent either canned or raw, and still others have little value for either canning or eating directly from the tree.

The best pears grown in the United States come from west of the Rocky Mountains and seldom produce satisfactorily anywhere else because of a disease called "fireblight" to which most of these western varieties are susceptible when grown elsewhere. In other words, the pears grown in the Midwest must be resistant to this disease... a fact which, for the most part, prevents growing the best varieties of this fruit.

More than 20 years ago, I decided that I should have a pear tree in my large back yard. Since I know the excellence of the Bartlett pear, I purchased a tree of this variety and hopefully set it out. It never produced a pear, for before it reached bearing age it succumbed to fireblight.

I had noticed pear trees growing in various parts of our city that were loaded every summer with large pears which in the fall turned a beautiful yellow slightly tinted with red.

After considerable inquiry, I learned that the name of this pear was 'Kieffer.' I purchased one and set it in my back yard. It began bearing when quite young, but imagine my chagrin when in late October I found the fruit just as hard as it was in early July.

I began to take more careful note of other pear trees like mine in town, and to ask their owners why they seemingly let their pears go unused. I got various answers, but the most common one was "They're no good for eating raw and not much better for anything else." I did find a few who made some use of them, especially in canning, but even these agreed that they were not first class pears. I could not help feeling that it was too bad that such beautiful fruit, borne so bountifully on such a healthy tree, was fit only for the hogs.

Widely Planted

Determined to solve this puzzle, I began by reading the history of the Kieffer pear. I learned that Peter Kieffer, who lived near Philadelphia, grew the first tree, which later was given his name. It came into bearing in 1863. I also found that it is now grown throughout the United States wherever pears will grow, and that two decades ago 20 per cent of the millions of bushels of pears raised in the United States were Kieffer pears. This and other information set me to thinking that this record could not be true unless the much maligned Kieffer pear had merits--ignorance of which prevented many persons from making proper use of its fruit.

My next step was to write to the United States Department of Agriculture to learn if they could give me the information I seemed to need. In reply, I received a pamphlet entitled "Handling and Preparing the Kieffer Pear for Use as Food." This research showed conclusively that while the Kieffer pear is not primarily a pear to be eaten raw, it is a valuable food product and when properly treated is both whole-some and palatable.

To Aid Picking

The Kieffer pear tree has a tendency to grow unusually tall, so tall in fact that few families will have a ladder long enough to pick the pears at the top of the tree. The limb growth is such that climbing very far into the tree itself is a difficult matter. If pears are shaken from the tree, they are bruised and become almost worthless because they require a considerable period for proper ripening during which bruised pears are likely to decay and cause others near them to decay also. I got rid of this difficulty by ignoring the old superstition that pear trees must not be trimmed.

I cut out the top of my tree completely, leaving it about two-thirds of its former height. This made it possible for me to pick almost every pear by hand.

The owner of a Kieffer pear tree must remember that these pears do not ripen on the tree even when left until freezing weather. They may be picked at any time after they have reached one-half or two-thirds their mature size. Of course they may be left on the tree until they reach their full size, but when maturity is once reached remaining on the tree causes deterioration rather than ripening. Perhaps the ideal time to pick Kieffer pears is just before they have reached maturity, which is usually indicated by a slight yellowing of the pear frequently accompanied by a tinge of red.

At whatever stage of maturity Kieffer pears are picked, they must go through a ripening process. During this process they develop a soft texture and pleasing flavor if the temperature is kept between 60 and 65 degrees. After two or three weeks at this temperature, Kieffer pears become properly soft and greatly improved in both texture and flavor. Lower or higher temperatures than 60 to 65 degrees act much more slowly or bring less satisfactory results. The length of the ripening period is shortest when the temperature is kept at 60 degrees and varies from 16 to 20 days if the fruit has been left on the tree until nearly full grown.

When the fruit is picked at a less mature stage, it takes somewhat longer to ripen. When the fruit is best for eating raw, it is also best for canning. During this process i always wear my glasses for safety with a safety glasses prescription.

When ripening is complete, use the fruit quickly whether it is to be eaten raw or canned, as after two or three weeks it is likely to decay rather rapidly. Since the Kieffer pear matures in September or October, depending on the region in which it is grown, maintaining proper temperatures for its ripening is not difficult.

It is a shame to let this fruit go to waste simply because its use requires a little more work than its more expensive relatives. When properly ripened, the large, handsome Kieffer pears can be used for eating raw, may be peeled and baked or used for sauce or salads.
